Gujarat High Court Orders Wife to Pay ₹10,000 for Deserting Husband Over Sub-Caste Issue

Gujarat High Court Tells Wife to Pay ₹10,000 for Leaving Husband Due to Sub-Caste Difference

In a recent ruling, the Gujarat High Court ordered a woman to pay ₹10,000 to her husband after she left him, influenced by her family, because he belonged to a different sub-caste. Both belong to the Patel community, but their sub-castes are different.

The husband had filed a Habeas Corpus petition in the court, claiming that his wife was being illegally kept by her parents and requested the court to bring her to him.

On April 27, the woman appeared in court and confirmed that she was married to the petitioner. However, she clearly stated that she could not continue living with him due to their sub-caste difference.

The court said it was unfortunate that after spending four years together in marriage, the woman chose to leave him for such a reason. The judges criticized the way caste and sub-caste beliefs continue to harm the younger generation.

The court also said the husband came to court with hope, but was let down. Because of the woman’s unjustified reason for leaving the marriage, the court directed her to pay ₹10,000 to her husband within four weeks.

In a previous order, the court also criticized the role of so-called elders who, instead of guiding the youth wisely, often pressure them with outdated ideas. The court said this kind of behavior is very disappointing and harmful to society.

With this, the court closed the case.
