In February 2021, a father who had been imprisoned for over three years due to false rape allegations by his daughter was acquitted by a special court. The man had been in jail since August 2017, after an FIR was lodged by his daughter’s uncle at the Modinagar police station.
Based on the complaint, the father was arrested under various sections of the IPC and the POCSO Act. He was sent to judicial custody, and the case was heard by special judge Mahendra Srivastava.
During the trial, special public prosecutor Utkarsh Vats revealed that the girl, who lived with her maternal uncle, had been persuaded by him to file false rape charges against her father. Eventually, the girl recanted her statement and admitted that she had framed her father under her uncle’s influence.
As a result, the court acquitted the father, who had spent over three years behind bars. Additionally, the judge fined the uncle ₹50,000 for provoking the girl to file the false case. The court also ordered that half of the fine would be given to the father as compensation.
On February 12, a special court in Ghaziabad sentenced the girl’s uncle to one month of simple imprisonment and imposed a ₹50,000 fine for his role in the false accusations.
