False Rape Allegation: Madhya Pradesh High Court Orders Probe Against Complainant
The Madhya Pradesh High Court has asked the Superintendent of Police (SP) in Sehore district to investigate a woman who allegedly filed a false rape complaint.
Justice Sanjay Dwivedi, while hearing a request for pre-arrest bail, strongly criticized the complainant’s actions. He said that filing false cases is a serious misuse of the law, and people who do this must be taught a lesson.
The case started when the woman accused a man of rape. But later, in her statements under Sections 161 and 164 of the Criminal Procedure Code (CrPC), she changed her story. When the accused applied for bail, the woman said she had no objection to his release.
She later admitted that the man had not raped her. She confessed that she made the allegation because the police told her to say so.
Justice Dwivedi said that if a non-bailable offense is found against the woman based on this false allegation, the police should take proper legal action against her.
The Court emphasized that laws meant to protect genuine victims should not be misused, and such behavior weakens the justice system.
