Educated Wife Still Entitled to Maintenance, Rules Punjab and Haryana High Court

Punjab and Haryana High Court: Educated Wife Still Deserves Maintenance

The Punjab and Haryana High Court has made it clear that a wife cannot be denied maintenance just because she is well-educated or has a postgraduate degree.

This judgment was given by Justice Bhardwaj while hearing a case where a husband challenged the Family Court’s decision. On March 7, the Family Court had ordered the husband to pay ₹2,500 per month from the date the petition was filed, and later ₹3,600 per month as maintenance to his estranged wife.

The husband’s lawyer argued that the wife left the marriage on her own and wasn’t entitled to any financial support. He also mentioned that she was highly educated, and therefore, didn’t need maintenance.

However, Justice Bhardwaj disagreed, saying there was no proof that the wife had left her husband without a valid reason. He said that Section 125 of the CrPC is meant to protect individuals from poverty and homelessness. The court explained that there’s no fixed rule for granting maintenance—it depends on things like the financial status of both parties, whether the wife has her own income, and the standard of living they had during the marriage.

The court also stated that the amount decided by the Family Court was fair, considering the husband’s income. Dismissing the husband’s plea, Justice Bhardwaj concluded that the lower court’s decision was legal and reasonable based on the facts of the case.
