In a recent ruling by a session court in Indore, a husband has been ordered to pay his wife a lump sum of Rs 25 lakh and a monthly maintenance of Rs 15,000. This decision comes after the court found him guilty of economic domestic violence for not meeting his wife’s basic needs, such as food, clothing, and household expenses, while they were living apart.
The court’s order was directed at Mahendra, a builder and engineer, who had disagreements with his wife leading to their separation. Previously, in 2008, the district court had instructed Mahendra to pay his wife Rs 5,000 per month. His wife appealed this decision in the Sessions Court through Advocate KP Maheshwari.
Mahendra argued that his wife was capable of earning her own income and thus, he should not be required to provide maintenance. However, the court rejected this argument. It was observed that not providing financial support to a wife, despite having the means to do so, constitutes economic domestic violence.
The court also noted that while the wife sought additional compensation for loss of property and mental and physical suffering, the evidence was insufficient to grant such relief. Furthermore, their daughter testified that her father covered their educational and daily expenses, leading the court to decide against further compensation for the wife.
