The Delhi High Court recently noted that dowry deaths are not just about male dominance but also involve women perpetuating hostility towards their counterparts. This disturbing pattern reflects a societal failure to view women as more than financial burdens.

Court’s Observations

Justice Swarana Kanta Sharma pointed out that dowry deaths reveal complex dynamics where women themselves participate in perpetuating hostility. This continues to enforce the idea that women are seen as financial burdens, overshadowing their education and career aspirations, especially in financially weaker sections of society.

Psychological Trauma Over Physical Violence

The Court observed that the psychological stress and emotional trauma caused by constant dowry demands can be more damaging than physical violence. Women often endure a life akin to slavery, forced to meet the insatiable demands of their in-laws, further compounding their distress.

Case Background

The Court’s observations came while dealing with a plea by Satpal Singh, who challenged his conviction and sentence related to his wife’s suicide in May 2000. In April 2009, the trial court convicted Singh under Sections 498A (cruelty towards wife) and 304B IPC (dowry death), sentencing him to 10 years of rigorous imprisonment.

Details of the Case

Justice Sharma noted that the deceased woman suffered relentless torment and was not allowed to contact her parents freely. Her phone calls were rationed, and she was denied basic necessities like food and clothing. The Court emphasized that subjecting a woman to such a life because of her marital status is a grave injustice.

Conclusion

The Court upheld the trial court’s order, stating that Singh must surrender within 30 days to serve the remaining portion of his sentence since he had been on bail since 2009.
