Divorce Granted Without Alimony as Wife Disobeys Court Order: Pune Court Ruling

Pune Court Grants Divorce Without Alimony as Wife Ignores Court Order

In a recent case from Pune, the court granted divorce without alimony to a man after his wife refused to follow a court order to live with him. The order was passed by Joint Civil Judge AP Girdkar.

Background of the Case

The couple got married in 2009. The husband had a job, while the wife was a housewife. Just four months after marriage, the wife left her husband. For the next four years, she would come and go, staying only for short periods. After 2013, she never returned.

In 2015, the husband sent her a legal notice, but she still did not respond. Finally, through his lawyer Adv. Shivajirao Deshmukh, he filed a case in court.

Court Order Ignored

In June 2018, the court ordered the wife to return and live with her husband within one month. However, she did not obey this order and did not appear in court either.

As a result, on January 18, 2020, the husband filed a divorce petition with the help of Adv. Shivajirao Deshmukh and Adv. Sai Deshmukh.

Even during the divorce proceedings, the wife did not attend court hearings. Due to the COVID-19 pandemic, court activities were delayed. Once court operations resumed, the judge delivered the final verdict.

Court’s Final Decision

The court granted divorce to the husband and clearly stated that he is not required to pay any alimony, as the wife had refused to comply with the court’s order.

This case highlights that when a spouse fails to cooperate with court directions, it can affect their claim to financial support in divorce matters.
