Pune Court Grants Divorce Without Alimony Due to Wife’s Non-Compliance

Divorce Without Alimony Due to Wife’s Refusal To Obey Court Order

In a notable case from Pune, a court has granted a man a divorce without alimony after his wife repeatedly ignored court orders to live with him. The Joint Civil Judge, AP Girdkar, issued this ruling based on the husband’s petition.

Case Background

The couple married in 2009. The husband works a job, while the wife is a housewife. Four months after their marriage, the wife left, but she would return occasionally for short periods over the next four years. After 2013, she stopped coming back altogether.

Legal Proceedings

In 2015, the husband issued a notice to his wife, but she did not respond. With the help of Advocates Shivajirao Deshmukh and Sai Deshmukh, he filed a petition in court. The court ordered the wife to return and resume married life with her husband. Despite the court’s order in June 2018, giving her a month to comply, she did not return.

Divorce Filing and Ruling

On January 18, 2020, the husband filed for divorce, again with the assistance of Advocates Shivajirao and Sai Deshmukh. The wife did not attend the court hearings. The COVID-19 pandemic caused delays in court proceedings, but once restrictions were lifted, the court granted the divorce. The ruling stated that the husband would not have to pay alimony as the wife failed to comply with the court’s order.

Implications

This case underscores the importance of compliance with court orders in marital disputes. The court’s decision to grant a divorce without alimony due to non-compliance sets a significant precedent for similar cases.
