Delhi High Court Acquits Four Men in 2018 Gang-Rape Case Due to Flawed Investigation

The Delhi High Court has acquitted four men who were previously sentenced to life imprisonment by a trial court for allegedly abducting and gang-raping a woman in 2018. The high court ruled that the investigation was flawed, leading to their acquittal.

The four men had appealed the trial court’s judgment, and the high court found that there was insufficient evidence to support the prosecution’s case. It noted that neither the woman nor her parents provided any strong statements that could substantiate the accusations.

The trial court had based its decision on the woman’s initial statement to the police on July 29, 2018, in which she accused the men of abducting her and forcing her into sexual relations. However, when presented before the magistrate, the woman stated that she had left her home voluntarily. She also confirmed this during her testimony, saying she had not been kidnapped or assaulted.

The prosecution alleged that the woman was abducted and gang-raped by four men on July 29, 2018, before managing to escape and alert the police. However, the woman later retracted her statement, testifying that she knew the men from her village but did not accuse them of any crime during the trial.

Although the woman confirmed her signature on various documents, she claimed that the complaint had been filed under her parents’ influence, essentially disowning all the allegations.

The high court was puzzled as to why the police failed to collect crucial call detail records (CDR) of the woman’s mobile, which could have provided important evidence. The court noted that withholding such vital information cast doubt on the prosecution’s case.

Regarding the DNA evidence, the court observed that the woman was an adult at the time of the incident, and while semen was found on her leggings and matched the DNA profiles of the accused, it could not be automatically concluded that a sexual assault occurred, as the woman herself did not make any such claims.

The bench, comprising Justices Suresh Kumar Kait and Manoj Jain, emphasized that the investigation was inadequate, noting that critical evidence like the PCR form and CDR were missing from the record. The DNA report was also not presented to the accused under Section 313 CrPC, weakening the prosecution’s case further. As a result, the appeal was allowed, and all four men were acquitted of the charges.
