Delhi Court Grants Custody of Children to Father, Prioritizing Their Welfare

In a rare judgment, a Delhi court has granted interim custody of two minor children, aged 4.5 years and 18 months, to their father. The court emphasized that while the mother has the right to live her private life, it should not come at the expense of the children’s well-being.

The mother left the family home in October 2020, taking both children with her. Following this, the father filed for custody, claiming that the mother’s alleged affair was having a negative impact on their children.

According to the court, the mother’s actions, such as spending three days in Goa with her lover while leaving the children with a maid, indicated a lack of proper care for the children. The court stated, “This unethical conduct of the mother would hamper the balanced and healthy growth of the children.” It was noted that the children needed love, attention, and care from both parents, something the mother had failed to provide.

Although the court acknowledged that the mother’s personal life was not directly relevant in deciding custody, it stressed that the priorities of parents play a crucial role in a child’s development. The court also pointed out that children with active, involved parents tend to perform better academically and emotionally.

The ruling highlighted that both children, being in their formative years, require undivided attention and care from their parents, which they were not receiving from the mother.
