Karnataka High Court Grants Divorce Due to Wife’s Cruelty Over Husband’s Dark Complexion

The Karnataka High Court recently granted a divorce to a man whose wife insulted him for his dark complexion and falsely accused him of having illicit relationships. The court ruled that this behavior amounted to cruelty, leading to the dissolution of the marriage.

A division bench, consisting of Justice Alok Aradhe and Justice Anant Ramanath Hegde, heard the case and overturned a family court’s decision that had previously denied the husband’s request for divorce. The couple had married in 2007 and had a daughter. However, by 2012, the husband approached the family court in Bengaluru seeking a divorce.

According to the husband’s claims, his wife frequently humiliated him because of his dark skin tone. In 2011, she also filed a false complaint against him and his family under Section 498A of the Indian Penal Code, accusing them of cruelty. Additionally, the wife left their home to live with her parents.

The wife denied these allegations and countered by accusing the husband of having an illicit relationship with another woman. She also claimed that she had been mistreated by her husband and his family.

The Karnataka High Court found no credible evidence to support the wife’s claims of infidelity. The court also noted that the birth certificate she produced did not mention any child born from the alleged relationship. The court emphasized that the baseless accusations had caused significant harm to the husband’s reputation.

Furthermore, the court observed that during cross-examination, the wife had agreed to rejoin her husband but refused to withdraw her complaints. This refusal indicated that she was not truly willing to reconcile with him, reinforcing the husband’s claim of cruelty.

The court concluded that the wife’s actions, including her refusal to withdraw the false complaints and her constant insults about the husband’s appearance, were acts of cruelty. As a result, the husband’s petition for divorce was allowed, and the court dissolved the marriage.

This case highlights the impact of emotional and verbal abuse within marriages and underscores the importance of fairness in handling marital disputes involving false allegations.
