A Mumbai court has sentenced a 25-year-old businessman to 1.5 years in jail for sexually harassing a minor girl by calling her an “item.” Special Judge SJ Ansari ruled that using such terms objectifies women in a sexual manner and amounts to outraging a woman’s modesty under Section 354 of the Indian Penal Code (IPC).

Key Observations by the Court

The court stated that the term “item,” often used in a derogatory manner, reflects the intent to demean and objectify women. Judge Ansari emphasized, “Such offenses should be dealt with firmly to set an example and protect women from inappropriate behavior.”

The man was convicted under Section 354 of the IPC and provisions of the Protection of Children from Sexual Offenses (POCSO) Act.

Case Background

The incident occurred in 2015 when the accused, who lived in the same neighborhood as the minor, repeatedly teased the girl on her way home from school. He accosted her, pulled her hair, and made inappropriate remarks. Despite her protests, he continued harassing her and claimed she couldn’t harm him.

The girl called the police emergency line, but the accused fled before they arrived. She later went to the police station with her father and filed a complaint. Her statement, along with her father’s, became critical evidence in the case.

Accused’s Defense Rejected

The accused argued that he and the girl were friends and that her parents objected to their friendship, leading to the complaint. However, the court found the girl’s testimony credible and dismissed his claims, stating, “There is no evidence to suggest the girl had any motive to falsely accuse him.”

The court concluded that the man repeatedly followed and harassed the minor with sexual intent. Despite no prior criminal record, the court declined to grant probation or show leniency due to the seriousness of the offense.

Verdict

The prosecution successfully proved that the accused had outraged the minor’s modesty and harassed her. The court sentenced him to 1.5 years in jail, sending a strong message against such behavior.
