Calcutta High Court Grants Custody of 4-Year-Old to Father Over Mother’s Friend
In a recent ruling, the Calcutta High Court has granted custody of a 4-year-old girl to her biological father, overruling a previous decision. The girl’s mother had tragically committed suicide on March 7, 2018, and the father was arrested in connection with the case. At that time, the minor was placed under the care of her maternal grandmother, Kajal Saha.
However, tragedy struck again when the maternal grandmother also took her own life. Following this, the child was placed in the care of Julie Roy, a family friend and neighbor of the deceased mother.
Initially, the court had decided that the minor would remain under Julie Roy’s custody, with the biological father only granted visitation rights. But after considering a report from a clinical psychologist who had evaluated the child, the court revisited its decision.
In its revised ruling, the Calcutta High Court emphasized that Julie Roy was not fit to be the child’s guardian. The court noted that she lacked the financial means to support the child’s upbringing, including her education. Julie Roy also had her own family to care for, including a grown-up son.
On the other hand, the biological father, an engineer with a stable financial background, had developed a strong bond with his daughter over time. The court noted the growing attachment between the father and the child and decided that it was in the best interest of the minor to stay with her father.
The court stated, “When the bonding between the father and the child is growing, we do not want to disturb the present position,” granting the father full custody.
This decision underscores the importance of the child’s well-being and the emotional bond between parent and child when determining custody.
