Bombay High Court Closes Rape Case on Condition of Social Service
In a recent decision, the Bombay High Court quashed a rape case after both the accused and the alleged victim agreed to settle their differences and perform social service for six months.
The decision was made by Justice Prasanna B. Varale and Justice S. M. Modak, who instructed both parties to submit certificates from organizations showing that they had completed their community service every second and fourth Saturday of each month.
Background of the Case
The case was originally registered in March 2020 after the alleged victim filed a complaint. However, in February 2022, she submitted a No Objection Certificate (NOC) affidavit, stating that the complaint was filed due to a misunderstanding and relationship issues with the accused.
She explained that they were once in a romantic relationship and were considering marriage. Their relationship became intimate, but later, she realized they were not compatible. After ending the relationship, a disagreement occurred, during which the accused showed private pictures to her family. In anger, she filed the FIR.
Mutual Agreement to Move On
Later, the alleged victim married someone else and started a new life. Both she and the accused decided to resolve the matter and move forward peacefully. They approached the court together to request the quashing of the FIR.
Court’s Final Order
Taking the situation into account, the Bombay High Court agreed to quash the criminal case. But the court added a condition:
- The accused must perform social service at Baal Welfare Children Trust in Chembur every second and fourth Saturday for six months.
- The alleged victim must do the same at Maru Ghal in Gorai, Borivali (W).
Both must provide proof of their service after six months.
