Bombay High Court Cancels Rape FIR After Victim Marries Accused

Bombay High Court Quashes Rape FIR After Woman Marries Accused

The Bombay High Court has quashed a rape FIR after the woman who filed the complaint married the accused and confirmed that their relationship was consensual.

The couple, both 25 years old, got married in Raigad after the FIR was registered in 2021 at Tilak Nagar Police Station, Mumbai. Initially, the woman had accused the man of rape on the grounds of a false promise of marriage, claiming they had a sexual relationship since 2017 and that he later refused to marry her.

She also alleged that the man sent obscene videos of her to her brother and aunt, leading to charges under IPC Sections 376 (rape), 504 (intentional insult), 506 (criminal intimidation), 376(N), and Section 67A of the Information Technology Act.

However, the woman later submitted an affidavit stating the FIR was filed due to a misunderstanding and that the relationship was consensual. Advocate Ganesh Gupta, representing the accused, said the woman now wanted to withdraw the case as they had resolved their differences and are married.

They are now parents to a six-month-old son. Advocate Nazneen Khatri, also representing the accused, told the court the couple is happily married, and the woman does not wish to pursue the case further.

The court accepted the request and officially quashed the FIR.
