Bombay High Court Quashes POCSO Case After Victim, Now Adult, Decides to Marry Accused
The Bombay High Court has quashed a POCSO case after the victim, who is now an adult, told the court she wants to marry the accused. The man also gave a written promise to marry her, and the court accepted it.
This case was from 2015, when the girl’s father had filed a complaint under the POCSO Act and IPC alleging sexual assault of his minor daughter. The complaint was registered by Navi Mumbai Police.
While hearing the case, the division bench of Justice Prasanna B. Varale and Justice Shriram M. Modak said that continuing the criminal case would harm the couple’s future.
“We are inclined to accept the request for quashing the FIR, only by considering their future,” the court noted.
During the case, the girl submitted that she and the accused were in love and planned to marry once they were stable in their careers. She had also filed an affidavit confirming this. Her parents supported her and submitted their own affidavits, saying that the FIR was based on a misunderstanding and they now accepted the relationship.
The victim also tried to explain her previous statements to the police, saying she was influenced to give them. The court, however, did not consider this part.
Still, based on the mutual consent and the accused’s promise to marry the girl, the court ruled in favor of quashing the FIR.
“When the applicant is present in court, we asked about his readiness to marry the victim girl. He gave an undertaking, and we have accepted it,” said the court in its final decision.
