Allahabad High Court Grants Bail to Rape Accused, Says Victim ‘Invited Trouble’

The Allahabad High Court has granted bail to a man accused of rape, stating that the victim “invited trouble” by agreeing to go to the accused’s house after drinking alcohol with friends. The court noted that the woman, who is an MA student, was “competent enough to understand the morality and significance of her act.”

This ruling was delivered by Justice Sanjay Kumar Singh on March 11, even though the incident took place on September 21 of the previous year. In the judgment, the court explained that both the victim and the accused were adults, and the woman understood the consequences of her actions.

The victim, a master’s student, had reported in her First Information Report (FIR) that she had gone to a bar with friends, where they all drank alcohol. She became intoxicated and needed assistance, which led her to agree to accompany the accused to his house. However, the accused took her to his relative’s house in Gurgaon instead of his Noida home, where she claimed the man raped her twice and touched her inappropriately on the way.

In his bail application, the accused argued that the incident was not a case of rape but rather a consensual relationship between the two. He also mentioned that he had no previous criminal record and had been in jail since December 2024. His lawyer requested bail, assuring that he would not misuse his release and would cooperate with the legal process.

The court, after reviewing the case, accepted the victim’s allegations but noted that she herself admitted to inviting trouble and acknowledged the significance of her actions. Despite her medical examination revealing a torn hymen, the doctor did not confirm sexual assault. Therefore, the court decided to grant bail to the accused.
