Delhi Court Orders FIR Against Woman and Father for False Rape Allegations

A Delhi court has ordered the filing of an FIR against a woman and her father for making false allegations of gangrape, cruelty, and wrongful confinement against her husband and his family. The court highlighted the severe impact these false charges have on the accused.

Case Background: The case dates back to 2014, when the woman’s father filed an FIR accusing the husband, father-in-law, and sister-in-law of demanding dowry and abusing the woman. The woman also accused her father-in-law and sister-in-law of gangrape.

Court’s Observation: Additional Sessions Judge Aanchal emphasized the gravity of false rape accusations, stating, “Rape is a heinous crime that must be dealt with strictly, but false allegations must also be addressed firmly as they cause immense humiliation and social isolation to the accused and their families.”

Acquittal and FIR Order: On May 9, the court acquitted the husband and his family members. The charges included sections 498A (cruelty by husband or relative), 342 (wrongful confinement), 323 (hurt), 406 (criminal breach of trust), 506 (criminal intimidation), and 34 (common intention) of the IPC. The father-in-law and sister-in-law faced additional charges under section 376D (gangrape). The prosecution failed to prove the allegations.

The court directed the SHO of Janakpuri police station to register an FIR under section 211 (false charge of offense made with intent to injure) of the IPC against the woman and her father within 24 hours of receiving the judgment. The police were also instructed to submit a detailed investigation report to the metropolitan magistrate within three months.

Court’s Critique: The court criticized the woman and her father, both of whom had legal backgrounds, for exploiting the legal system. “Their actions go beyond mere exaggeration and constitute an illegal act, punishable with imprisonment extending to life,” the court noted.
