No Husband Can Accept Wife’s Vulgar Chats with Other Men: Madhya Pradesh High Court

The Madhya Pradesh High Court has upheld a family court’s decision to grant divorce to a man after finding that his wife’s vulgar chats with other men amounted to mental cruelty.

The couple got married in 2018. The husband, who is partially deaf, claimed that soon after the marriage, his wife started misbehaving with his mother. Within two months, she left the matrimonial home.

He further alleged that his wife was in contact with her “old lovers” over mobile chats, and the conversations were vulgar in nature.

The wife, however, denied the allegations. She claimed that her husband hacked her phone and fabricated the chats to frame her. She also alleged that he demanded ₹25 lakh dowry and physically assaulted her.

Despite her claims, the High Court noted that her father himself admitted that she often talked to male friends. The court also pointed out that the wife never filed a complaint or FIR for domestic violence against her husband, which weakened her case.

A bench of Justices Vivek Rusia and Gajendra Singh held that a husband or wife cannot have vulgar or indecent conversations with friends of the opposite gender after marriage. Such behavior, if continued despite objections, amounts to mental cruelty.

The Court observed:

“No husband would tolerate his wife engaging in vulgar chatting with other men. Married partners can communicate with friends, but the level of conversation must remain decent and dignified.”

Accordingly, the wife’s appeal was dismissed, and the divorce granted to the husband was upheld.
