The Allahabad High Court has granted bail to a man accused of rape, observing that the complainant was mature enough to understand her actions and had “invited trouble” by going to his house after consuming alcohol with friends.
The order, passed by Justice Sanjay Kumar Singh on March 11, relates to an incident from September 21 last year. The court noted that since the woman was a master’s student (MA), she was competent to understand the morality and significance of her decisions.
In her FIR, the complainant stated that she and her friends had gone to a bar where they consumed alcohol, after which she felt intoxicated and needed support. She said she agreed to accompany the accused to his house to rest. However, she alleged that instead of taking her home in Noida, the accused took her to his relative’s house in Gurgaon, where he raped her twice. She also claimed he touched her inappropriately on the way.
The accused, through his lawyer, argued that the case was not one of rape but of a possible consensual relationship, given the circumstances described by the complainant. He further submitted that he had been in jail since December 2024, had no prior criminal record, and would not misuse bail if released.
The court highlighted that even if the victim’s allegations were accepted as true, her own statements suggested that she had played a role in the situation. It also pointed out that during her medical examination, her hymen was found torn, but the doctor did not confirm sexual assault.
On these grounds, the Allahabad High Court granted bail to the accused.
