Supreme Court Protects Man Accused of Rape by Ex-Wife After Four-Year Delay in FIR
The Supreme Court has granted temporary protection from arrest to Paras (29), who was accused of rape, blackmail, and forcing his ex-wife into prostitution. The complaint was filed in April 2023, nearly four years after the couple divorced.
The case began in 2019, when Paras, a Hindu man, converted to Islam to marry a Muslim woman. The two tied the knot in April 2019, despite Paras being aware of her alleged involvement in sex work. The couple sought protection from the Rajasthan High Court, claiming threats from her family, and the Court granted them protection in May 2019.
Their marriage, however, was short-lived. In July 2019, the woman divorced Paras. Years later, in 2023, she filed an FIR accusing him of rape, blackmail with intimate photos, and pushing her into prostitution.
Paras approached various courts seeking protection before finally turning to the Supreme Court, where he argued that the FIR was delayed by four years, and was motivated by harassment and extortion.
“The woman herself admitted the marriage and Paras’s conversion to Islam. The FIR has been filed just to trouble him and demand money,” stated Paras’s plea.
His lawyer pointed out that between 2019 and 2023—the same period during which the alleged crimes occurred—the woman had also requested police protection from her own family, which contradicts her accusations.
Paras claimed that the allegations were false, and that his ex-wife continued her earlier lifestyle even after marriage, leading to their separation.
The plea also argued that:
- No clear evidence or witness supports the allegations.
- The woman wrongly claimed that Paras dragged her into prostitution.
- Legal requirements for charging Paras under the IPC were not fulfilled.
The Supreme Court agreed to consider his anticipatory bail plea and issued a notice, while preventing any arrest for now.
