Bombay High Court Gives Bail to Rape Accused, Says Relationship Was Consensual
The Bombay High Court has granted bail to a man accused of rape, on the condition that he must marry the survivor if she is found within a year. The Court noted that the relationship between the two was consensual, and the woman was an adult when the incident took place.
Justice Bharati Dangre passed the order after the accused submitted an affidavit stating he was ready to marry the survivor and accept the child as his own. However, the public prosecutor told the Court that the woman is currently untraceable, and the child born out of the relationship has already been placed for adoption.
The Court observed that since the woman was a major and had admitted the relationship was consensual, bail could be granted. The judge added that if the survivor is located within a year, the man must marry her as per his commitment. After one year, he would no longer be legally bound by that promise.
The accused and the survivor began a relationship in 2018 and planned to get married with the approval of both families. In October 2019, the woman discovered she was six months pregnant. When she informed the man, he allegedly stopped communicating and refused to marry her. She then filed a complaint accusing him of rape and cheating.
Later, the woman gave birth away from her home and left the baby at someone else’s house. The child was later admitted to a child care center. Due to this, the woman was also booked for abandoning her baby, which may be why she is currently missing, the Court said.
The Court ordered that the accused be released on bail upon furnishing a bond of ₹25,000.
