False Accusations Against Husband’s Family Misuse Legal Process, Says Telangana HC
The Telangana High Court has ruled that filing false or vague allegations against the relatives of a husband in matrimonial disputes can lead to misuse of the law. The Court stressed that such accusations, if not based on clear facts or evidence, waste judicial time and cause unnecessary harassment.
In this particular case, a woman accused her husband of physical and mental harassment for dowry. She also alleged that her brother-in-law had molested her, leading to charges under Section 354 of the Indian Penal Code (IPC). The brother-in-law, along with the sister-in-law and mother-in-law, requested the High Court to dismiss the criminal proceedings against them.
The woman claimed the molestation took place on 12 June 2007, but the Court observed that she did not report it promptly. As a working professional (software engineer), she was expected to take timely legal action if the allegation was genuine.
The High Court noted that the claims made in the complaint, FIR, charge sheet, and witness statements lacked enough evidence to prove that the husband’s relatives were involved in any criminal act. The bench said that the allegations were “omnibus in nature”, meaning they were broad and lacked specific instances.
Justice A. Santhosh Reddy, while delivering the verdict, stated that there was no sufficient material to proceed against the petitioners and continuing the trial would be a misuse of the legal system.
As a result, the High Court quashed the criminal case against the husband’s relatives to prevent them from facing unnecessary legal hardship.
