Allahabad High Court Grants Bail to Woman Accused of Killing Husband, Citing Humanitarian Grounds
The Allahabad High Court has granted bail to Khushbu Devi, a woman accused of killing her husband with the help of her mother and alleged lover, Sushil Yadav. The Court said the bail was granted on humanitarian grounds, as her minor children were left alone in an abandoned condition.
Justice Rajesh Singh Chauhan passed the order by applying Section 480 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Court noted that the woman has been in jail, her husband is dead, and there is no one else in the family to take care of her children.
Khushbu Devi is facing serious charges under Sections 103(2), 238(b), 3(5), and 61(2) of the BNS. According to the FIR, she was in an illicit relationship with her co-accused Sushil Yadav even before her marriage to the victim, Prem Kumar. It is alleged that she, along with her mother and Yadav, murdered her husband and dumped the body in a well to gain control over his property.
Her lawyer argued that the case was false and based only on the confession of the co-accused. There were no eyewitnesses or direct evidence, and no complaints had ever been made about her behavior during the marriage.
The defense further stated that the real reason for seeking bail was that her children were left alone and had no guardian, making her custody a humanitarian concern.
Considering these facts, the Court decided to release Khushbu Devi on bail, laying out strict conditions:
- She must give a written promise not to delay the trial when witnesses are available.
- She must attend the court either personally or through her lawyer on every date.
- She must be present in person during major stages of the trial like charge framing and statement recording.
- If she misuses her bail or skips court without a valid reason, legal action will be taken under Sections 269 and 208 of BNSS.
The Court clearly stated that this bail is given only for the sake of her minor children, and other accused in the case cannot use this decision to get bail for themselves.
