MP High Court: Husband and Wife Must Live Together with Adjustment

“Husband and Wife Expected to Live Together with Sense of Adjustment”: MP High Court

The Madhya Pradesh High Court recently emphasized that a sense of mutual adjustment is essential for a husband and wife to maintain their marital bond. This observation was made by Justice Rohit Arya and Justice Milind Ramesh Phadke while addressing an appeal filed by a wife challenging a decree for Restitution of Conjugal Rights (RCR) granted to her husband.

The couple tied the knot in April 2015 but began living apart shortly after, in May 2015. In May 2018, the husband filed a petition under Section 9 of the Hindu Marriage Act, 1955, seeking restitution of conjugal rights in the First Additional District Judge’s court in Dabra, Gwalior. The court, recognizing his genuine intentions, ruled in his favor and granted the decree.

The wife appealed against the decision in the High Court. However, during the hearing, she expressed her willingness to reunite with her husband, stating she no longer wished to pursue the appeal. The husband assured the court that he would provide her with a dignified, respectful, and comfortable life within his means.

Acknowledging the husband’s commitment and the wife’s willingness to reconcile, the court upheld the decision of the lower court and appreciated the husband’s gesture towards his wife.
