In a major relief for Mohammed Shameer and his family, the Karnataka High Court has quashed a dowry harassment case filed by his estranged wife, Jasmine. The case, which included allegations of assault and dowry demands, also named Shameer’s 80-year-old bedridden grandmother as an accused.
Shameer and Jasmine got married on October 24, 2020. However, soon after, marital disputes arose, and Jasmine moved back to her parents’ home. In March 2021, Shameer filed a civil suit against Jasmine to restrain her from interfering in his household matters. Later, in June 2021, he filed for divorce.
In response, Jasmine lodged a complaint against Shameer and his family, accusing them of dowry harassment and even attempting to kill her. The accused included Shameer’s parents, brother, sister-in-law, and a distant relative, alongside the bedridden grandmother.
The petitioners argued that the complaint was an act of retaliation against the civil suit and divorce petition. They highlighted the inclusion of the grandmother as a clear example of misuse of the law. Jasmine did not respond to legal notices, while the government advocate contended that the chargesheet justified continuing the case.
Justice M. Nagaprasanna, presiding over the case, noted that the allegations lacked evidence. The judge stated that while Section 323 of the Indian Penal Code (assault) was invoked, no proof of an attempt to kill Jasmine was presented. He criticized the vague and unsupported allegations against the other family members, emphasizing that even a bedridden grandmother was unjustly implicated.
“Allowing proceedings to continue under such circumstances would amount to an abuse of the legal process,” Justice Nagaprasanna said. The court quashed the case, providing relief to the family and calling for cautious application of legal provisions to prevent misuse.
This judgment underscores the importance of safeguarding the judicial process from being exploited and ensuring that justice is served fairly for all parties involved.
