Chief Justice’s Advice to Woman in Divorce Case: “Find a Job and Avoid Long Legal Battles”

Chief Justice of India, DY Chandrachud, recently advised a couple involved in a matrimonial dispute to consider a divorce by mutual consent, highlighting that a lengthy legal fight would only benefit lawyers. During the hearing of a petition to transfer the case, the Chief Justice stressed that it would be in both parties’ best interest to avoid prolonged litigation.

In the courtroom, the Chief Justice asked the woman about her educational background. The woman revealed that she holds an MTech degree and a doctorate from a prestigious US university. When asked about her current employment, she admitted that she wasn’t working at the moment. The Chief Justice was surprised and encouraged her to seek employment, saying, “You are so educated, and you do not have a job? You must find a job for yourself.”

He further advised the woman to think about resolving the dispute amicably through mutual consent. “You can spend 10 years fighting this case, but it will only benefit the lawyers. Why not be reasonable and agree to divorce by mutual consent? If you both agree, we can close all the ongoing cases,” he suggested.

The Chief Justice pointed out that it was clear the couple could not reconcile and stated that, given the woman’s qualifications, she could easily find a job. He added, “If you were uneducated or illiterate, the situation might be different, but with your education and skills, you should focus on building your future.”

By choosing a mutual consent divorce, the couple would save time, money, and emotional stress, while preventing a drawn-out legal battle that would only serve the interests of their lawyers.
