Punjab and Haryana High Court Quashes Rape FIR Against Man Not in India During Incident

The Punjab and Haryana High Court recently quashed an FIR filed against a man accused of gang rape, as it was discovered that the accused was not in India at the time of the alleged incident. The court ruled in favor of the accused after it was confirmed by the Investigating Officer that he was in London during the time the offense supposedly took place.

Justice Jagmohan Bansal, presiding over the case, described the FIR as a case of blackmail and an abuse of the legal process. The judge further remarked that false accusations like this make it difficult for the courts to differentiate between genuine cases and those that are fabricated.

The petitioner submitted documents proving that he had left India on January 26, 2019, while the alleged incident occurred on the night of February 1-2, 2019. Based on these facts, the court found it highly improbable that the petitioner was involved in the crime.

The court also noted that the prosecutrix had turned hostile against three other accused individuals, further casting doubt on the credibility of the case. Justice Bansal expressed disappointment that such serious accusations were made against someone who was not even in the country.

Consequently, the court quashed the FIR, bringing an end to the case.
