The Karnataka High Court has revised a 2016 Trial Court order that required a husband to provide his estranged wife Rs. 6,000 per month as maintenance and a room in their shared house. Instead, the husband will now pay an additional Rs. 5,000 for alternate accommodation along with the maintenance.
Justice V Srishananda, a single judge, made this decision after the husband filed a memo agreeing to pay both amounts. The ruling is based on Section 19(1)(f) of the Protection of Women from Domestic Violence Act, 2005, which allows the court to order monetary compensation instead of providing accommodation in the shared house.
The judge noted that the husband was living with his first wife and requiring the estranged wife to stay in the same house, even in a separate room, could cause more conflicts, possibly leading to civil or criminal cases.
Therefore, the court ruled that paying Rs. 5,000 for alternate housing would be more practical and fair. This amount would allow the wife to find suitable accommodation, exceeding the value of staying in the shared house as initially ordered by the Trial Court.
