Bombay High Court Declines to Quash FIR Against Disabled Man Accused of Molestation

The Bombay High Court has refused to quash an FIR filed against a disabled man accused of molesting and intimidating a woman. A bench consisting of Justices Revati Mohite Dere and SM Modak ruled that the case does not qualify for the court’s extraordinary or inherent jurisdiction to dismiss it.

The incident dates back to March 2021, when the woman claimed that the accused approached her in a market, held her hand, and made inappropriate comments, including asking her to come with him. He allegedly followed her multiple times, asked for her phone number, and made suggestive remarks. The victim further alleged that in June 2021, the accused pulled her into his car, molested her, and threatened to kill her if she revealed the incident.

As a result, the accused was charged under various sections of the Indian Penal Code, including 354 (outraging modesty), 354D (stalking), 342 (wrongful confinement), and 506 (criminal intimidation).

The accused argued that the FIR was false and motivated by malice, citing his disability as a reason he could not have committed the alleged acts. However, the High Court dismissed his plea but instructed the trial court to handle the case without being influenced by its decision.
