A Surat-based man has been ordered to pay Rs 2 lakh per month in maintenance to his estranged wife and two children after failing to comply with a previous court order of Rs 12,000 per month. The case dates back to March 2017 when the wife approached the family court seeking financial support.
The woman claimed her husband, who allegedly abandoned her in 2016, earned Rs 25 lakh per month from his diamond business. She initially demanded Rs 3 lakh per month for herself and Rs 1 lakh per child as maintenance. However, the husband denied being that wealthy, stating that he only worked in diamond job work and didn’t own a factory.
In November 2019, the family court, unable to verify the husband’s income, estimated his earnings to be between Rs 40,000 and Rs 50,000 per month. Based on this, he was ordered to pay Rs 6,000 to his wife and Rs 3,000 to each child. Despite this ruling, the husband allegedly failed to make any payments.
The wife then approached the high court in February 2021, asking for an increase in the maintenance amount to match her original demand. At the same time, the husband challenged the maintenance order. The high court ordered the man to pay Rs 3.25 lakh in arrears for failing to support his family.
By September 12, 2023, the wife’s lawyer, Rajendra Jadhav, informed the court that the man had still not made any payments and had ignored the court’s February 2021 directives. It was further alleged that he was influential enough to avoid court warrants and legal consequences.
After hearing these claims, Justice Samir Dave expressed his dissatisfaction with the husband’s conduct. He increased the maintenance amount from Rs 12,000 to Rs 2 lakh per month and revised the arrears, raising them from Rs 7.92 lakh to Rs 1.32 crore, dating back to March 2017.
