The Delhi High Court has granted a divorce, declaring that a wife’s actions, such as behaving like a widow while her husband was seriously injured, amounted to extreme cruelty. Justices Suresh Kumar Kait and Neena Bansal Krishna made this ruling while dismissing the wife’s appeal against a family court decision.
The court observed, “Nothing is more harrowing for a husband than to see his wife act as a widow while he is still alive, especially when he was seriously injured and expected care and compassion from her. Such behavior can only be seen as extreme cruelty.”
The High Court’s judgment came as it reviewed a case where the family court had previously ruled in favor of the husband’s divorce petition, citing the wife’s cruel conduct. The court concluded that there was no chance of reconciling the couple, noting that their relationship had deteriorated with false allegations, police reports, and ongoing litigation.
The judges highlighted that a strong marital relationship requires cohabitation and mutual support. They pointed out that the couple’s marriage, which began in April 2009, had deteriorated significantly. The wife had left her home shortly before giving birth to their daughter in October 2011.
The husband’s petition claimed that the wife had been indifferent from the start of their marriage, failing to fulfill her marital duties. He alleged that she refused to perform household chores, leading his father to take over daily tasks. The woman denied these claims and argued that her husband encouraged her to leave for her parental home, only for her to return after three days.
The husband also described an incident in April 2011 when he suffered a slipped disc. Instead of caring for him, the wife reportedly removed her vermillion, broke her bangles, and wore a white suit, symbolizing widowhood. The court viewed this as a clear rejection of their marital relationship.
The bench clarified that not observing certain religious practices, like fasting on Karwa Chauth, might not in itself be cruel. However, when combined with other actions, such as rejecting traditional rituals symbolizing respect and love for the husband, it indicated a lack of respect for the marriage.
Ultimately, the court determined that the wife’s conduct demonstrated her unwillingness to continue the marriage and granted the divorce on grounds of extreme cruelty.
