Man Granted Bail After 17 Months in Jail as DNA Proves Teen’s Baby Not His

On January 25, 2022, a restaurant worker who spent 17 months in jail for allegedly raping and impregnating his 19-year-old deaf and mute neighbor was granted bail after DNA evidence revealed he was not the father of the child.

The man was arrested on August 1, 2019, and a chargesheet was filed. The court noted that it would take time to decide the case on its merits. Given the DNA report showing he was not the father, the court granted his bail.

The incident came to light when the young woman, a class 7 student, complained to her teacher about stomach pain on July 23, 2019. The teacher informed her father, who then took her to the doctor. A sonography test revealed she was six months pregnant. Using sign language, she told her family that five to six months earlier, while on her way to a public toilet, the accused forcibly took her to his house, sexually assaulted her, and took her photographs. The family reported the incident to the police, leading to his arrest.

The prosecution opposed the bail, arguing that the accused took advantage of the woman’s vulnerabilities and could tamper with evidence or threaten the woman and witnesses if released.

The court granted bail on a surety of Rs 30,000, with strict conditions. The accused was ordered not to contact the woman or visit her and to attend all court dates without fail. He was also required to submit proof of his residential address, phone number, Aadhaar card, and election ID.

This case highlights the importance of DNA evidence in ensuring justice and protecting the rights of the wrongfully accused.
