Karnataka High Court Orders Husband to Pay Rs 25,000 for Wife’s Legal Expenses in Divorce Case

The Karnataka High Court recently instructed a husband to pay Rs 25,000 to his wife for litigation expenses. This will enable her to hire a lawyer and contest the divorce proceedings he initiated.

The couple, married on December 26, 2011, have two children. The husband filed for divorce under Sections 13(1)(i) and (ia) of the Hindu Marriage Act. In response, the wife requested Rs 75,000 for legal fees under Section 24 of the same act, to engage an advocate and fight the case.

The trial court rejected her application, suggesting she seek assistance from the District Legal Service Authority instead. The wife then approached the high court, while the husband requested a swift resolution of the case.

The wife argued that her husband, working as Head of Human Resources and earning over Rs 80,000 per month, should contribute towards her legal expenses. She claimed she had no income and was responsible for their two children.

Justice S G Pandit considered the submissions and ruled that Rs 75,000 was excessive. He deemed Rs 25,000 as a reasonable amount for litigation expenses. The court also urged both parties to cooperate for an expedited trial.

The trial court was directed to quickly resolve the husband’s plea for divorce.
