The Bombay High Court has reinforced the principle that true women empowerment must align with accountability and integrity. The court upheld the removal of Pratima Gaikar, a woman Sarpanch from Ambivali village, Raigad district, for gross misconduct.
Justice NJ Jamadar quashed an earlier order by Maharashtra’s Rural Development Minister, who had condoned Gaikar’s misconduct on the grounds that removing her would contradict the policy of women empowerment. The court ruled that condoning such behavior undermines the democratic principles of integrity and fairness.
“Empowerment of women through political representation is a key aspect of strengthening democracy at the grassroots level. However, condoning gross misconduct in the name of women empowerment defeats its purpose,” the court stated.
The case began when the Divisional Commissioner ordered Gaikar’s removal on April 19, 2022, for misappropriating ₹15,549. She had withdrawn the amount by issuing a cheque with an Anganwadi Sevika, instead of the appointed Asha Sevika, thereby violating government regulations. However, the Minister overturned this decision, arguing that removing a woman Sarpanch would harm the cause of women empowerment.
The High Court, however, emphasized that misconduct must be addressed to maintain democratic integrity. “Removal of an office bearer for proven misconduct serves a larger public interest and strengthens democracy. If the post is reserved for women, another qualified woman can assume the role,” the court added.
The ruling reinforces the idea that empowerment does not excuse misconduct. Accountability is essential for genuine progress in women’s representation in governance.
This verdict is a significant reminder that democratic principles and ethical governance must prevail, even while promoting women’s empowerment in India.
