Delhi Court Urges Woman to Get a Job Instead of Relying on Ex-Husband for Alimony

A Delhi court recently advised a woman to seek employment, emphasizing that she is qualified and capable of working, rather than depending financially on her estranged husband. This decision may spark discussions about India’s alimony system.

The court’s decision followed an appeal by the woman’s ex-husband, who contested an order requiring him to pay Rs 12,000 per month in spousal support. The man agreed to assist her in finding a job and offered to provide financial support for one year.

District Judge Rekha Rani noted that the woman herself admitted to being more qualified than her former spouse and capable of earning a living. “The respondent (woman) acknowledged that she is more educated than the appellant (man) and is physically able to work. Therefore, she cannot be permitted to remain unemployed and place financial pressure on her ex-husband,” the judge stated.

The woman had argued that despite her qualifications, she married young, had never held a job, and had not traveled alone. However, the ex-husband pointed out that she was a gold medalist with an MSc degree and had not made any efforts to secure employment. He argued that she was deliberately avoiding work to depend on him financially.

In response to the woman’s claim that she had never traveled alone and wanted her ex-husband to accompany her on job searches, the court dismissed the argument. Judge Rani remarked, “This claim is neither convincing nor reasonable. If she can attend court hearings independently, she is fully capable of looking for a job on her own.”
