The Gujarat High Court recently issued a notice to a woman who divorced her husband, citing cruelty. The woman claimed that her husband hid the fact that his sister married outside their caste, which became a central reason for their separation.
According to reports, the couple had an arranged marriage in 2018. The issue began just two days after the wedding when the woman discovered that her sister-in-law had married into a community she viewed as lower on the social caste hierarchy.
In 2020, the woman filed for divorce in the Bhavnagar family court. She argued that her husband deliberately concealed this information during their engagement. Although he mentioned having two sisters, he did not disclose a third sister who had an inter-caste marriage. The wife only became aware of this at their wedding ceremony.
Additionally, the woman alleged that her husband filed a police report accusing her family of threatening his life and sent it to her workplace, adding to her grievances.
The husband, in response, filed a case seeking restoration of conjugal rights, urging the court to order his wife to return to their marital home. However, on September 30, 2024, the Bhavnagar family court dismissed his plea and granted the divorce.
Dissatisfied with the outcome, the husband challenged the decision by filing two separate appeals in the Gujarat High Court, seeking to overturn the divorce order.
After a preliminary review, Justices Biren Vaishnav and DM Desai noted that a significant basis for the woman’s claim of cruelty was related to her husband’s sister’s inter-caste marriage. The court has scheduled a joint hearing for both appeals on January 20.
This case highlights the complexities of marital expectations and societal norms, sparking conversations about caste and modern relationships.
