The Karnataka High Court recently ruled that if one spouse causes significant distress and unhappiness to the other, it can be seen as cruelty, justifying a divorce. This ruling came from a Division Bench led by Justices A. Muhamed Mustaque and Sophy Thomas. The court stated that it cannot leave any spouse’s life to the mercy of the other.
The court explained that if a husband and wife are unable to maintain a meaningful marital relationship due to deep-seated differences and one spouse wants a separation while the other withholds consent, it can lead to mental suffering and be considered cruelty. This decision reinforces the idea that enduring such conditions can be grounds for granting a divorce.
