A Delhi court recently ruled that a wife who is capable of earning cannot remain unemployed and financially burden her husband. The judgment was issued in response to a man’s appeal against paying Rs 12,000 per month in spousal support.
District and Sessions Judge Rekha Rani, who delivered the judgment, noted that the woman admitted to being more qualified than her husband and fully capable of earning a living. “The respondent (woman) acknowledged that she was more qualified than the appellant (man). She is able-bodied and capable of earning. Therefore, she cannot be allowed to sit idle at home and strain the appellant’s finances,” said the judge.
The wife had argued that although she was highly educated, she had never worked due to being married at a young age and lacking experience in travelling alone. Meanwhile, the husband argued that since she was more qualified than him—an M.Sc gold medalist—she was not entitled to financial support. He claimed she had made no effort to apply for jobs and was choosing to remain unemployed, thus becoming a financial burden on him.
The court ultimately sided with the husband, allowing him to continue paying the Rs 12,000 monthly support for one year, as previously ordered. However, during this period, the wife is expected to actively seek employment. The judge emphasized that the wife should make sincere efforts to find a job and support herself.
This ruling highlights the court’s view that an educated and capable spouse should contribute financially rather than relying solely on the other partner, especially when they have the ability to earn.
