The Case Details
Justice Jasjit Singh Bedi delivered the ruling after an estranged wife filed a revision petition against an earlier order. The order, dated October 13, 2021, recommended an inquiry under Section 191 of the Indian Penal Code (IPC) against the woman for submitting false evidence in her maintenance claim.
The petitioner had joined a private university as an Assistant Professor on July 3, 2017, earning ₹28,000 per month. However, she filed a petition under Section 125 of the Code of Criminal Procedure on July 26, 2017, claiming to be unemployed.

Justice Bedi highlighted the petitioner’s failure to disclose her employment during the court proceedings, stating that her explanation was “completely fallacious.” The court noted that it is the primary duty of a party seeking maintenance to honestly disclose their financial situation so that the appropriate quantum of maintenance can be determined.
