The Chhattisgarh High Court has ruled that if a wife goes to her husband’s workplace and abuses him, it amounts to mental cruelty, which can be a valid ground for divorce.
This decision came while the court was hearing an appeal from a woman challenging the Raipur family court’s 2019 ruling that granted divorce to her husband. The High Court upheld the lower court’s verdict.
The couple got married in 2010. The 32-year-old husband, a government employee from Dhamtari district, claimed that his 34-year-old wife, a widow from Raipur, would often create public scenes at his office, insult him, and prevent him from meeting his parents. He also accused her of making false claims about his alleged affair with a female colleague and even wrote to a government minister seeking his transfer.
The husband approached the Raipur family court seeking divorce, citing mental and emotional abuse. In December 2019, the family court granted him divorce based on the evidence presented.
The wife appealed this decision in the High Court, stating that she was the one subjected to cruelty and accused her husband of trying to fabricate evidence to get a divorce.
However, the High Court bench, consisting of Justices Goutam Bhaduri and Radhakishan Agrawal, found that the woman had made baseless allegations against her husband, including an extramarital affair. Witness statements, including one from the wife’s sister, confirmed that she would regularly abuse him at work and physically mistreat him at home. The husband had also filed complaints with the police, although no action was taken since the issues were non-cognizable.
The court observed that the wife’s actions had damaged the husband’s reputation at work and within his family, as she stopped him from meeting his parents and insulted his in-laws.
The High Court concluded that such behavior clearly amounted to mental cruelty and upheld the divorce granted by the family court.
