A Mumbai court refused to grant interim maintenance to a woman who earns more than her husband, stating that her income makes her ineligible for spousal support. However, the court directed the husband to pay for the child’s maintenance.
The Bombay High Court ruled that an employed wife still deserves maintenance if her income isn’t enough to maintain the same standard of living she had in her matrimonial home. The husband must pay ₹15,000 monthly despite claiming her earnings were sufficient.
The Supreme Court ruled that a wife earning a sufficient salary is not entitled to maintenance. However, the daughter was granted ₹30 lakh for her care and future expenses.
