The Allahabad High Court has ruled that grabbing breasts or pulling a pyjama string does not amount to rape or attempt to rape but constitutes aggravated sexual assault under POCSO, sparking criticism and calls for Supreme Court review.
The Allahabad High Court granted bail to a rape accused, ruling that the complainant was mature enough to understand her actions. The court said she “invited trouble” by going to his house after drinking with friends.
The Allahabad High Court ruled that in rape cases, it cannot always be presumed that the victim tells the whole truth. While granting bail to the accused, the Court found that the relationship was consensual, not forced.
