Supreme Court Halts Divorce Case as Wife Seeks IVF Cooperation from Husband

Supreme Court Pauses Divorce Case as Wife Seeks IVF Cooperation from Husband

The Supreme Court has temporarily halted divorce proceedings between an estranged couple after the wife requested her husband’s help in undergoing in-vitro fertilization (IVF). She wants him to provide his sperm so they can have a child.

The woman also approached the top court to transfer the ongoing divorce case from Bhopal, where her husband filed it, to Lucknow, where she currently resides with her parents. Justice Pankaj Mithal agreed to hear her plea.

Marriage and Delayed Parenthood

In her petition, the 44-year-old woman stated that she and her husband got married in November 2017. Despite multiple requests, he kept postponing parenthood, citing unemployment as the reason.

After several discussions, her husband finally agreed to conceive a child through IVF. In March this year, they both underwent medical tests and started taking necessary medications under a doctor’s supervision.

Sudden Divorce Filing During IVF Treatment

The woman claimed that just as they were undergoing IVF treatment, her husband unexpectedly filed for divorce. He then cut off all contact with her, blocked her calls, and left her emotionally distressed.

She also alleged that she was forced to leave her marital home and now faces difficulties fighting the case in Bhopal while living with her parents in Lucknow.

Supreme Court’s Decision

The Supreme Court, in its order on December 1, put the divorce case on hold. The bench issued a notice to the husband, asking him to respond within six weeks.

Meanwhile, the woman has also filed a separate application requesting the court to direct her husband to cooperate with the IVF process, including providing his sperm whenever required by doctors.

Her plea mentioned that after marriage, her husband initially revealed his unemployment and asked her to stay with her parents temporarily. He had promised that they would have a child once he secured stable employment, which he later did.

Now, the Supreme Court’s intervention will determine how the case unfolds.
