Supreme Court Sends Judge for Training Over Bail Denial
The Supreme Court has taken strict action against a sessions judge by withdrawing his judicial work and ordering him to undergo training at the judicial academy. This decision was made after trial courts repeatedly failed to grant bail in cases where custody was unnecessary, despite clear directives from the apex court.
On March 21, the Supreme Court had issued a warning that judges failing to comply with bail rulings would have their judicial responsibilities revoked and would be sent for training. However, Justices Sanjay Kishan Kaul and Ahsanuddin Amanullah were informed that many courts, particularly in Uttar Pradesh, continued to deny bail unjustly.
Cases That Prompted Action
Senior advocate Sidharth Luthra, acting as amicus curiae, presented two cases where bail was denied unfairly:
- Matrimonial Dispute: A sessions judge in Lucknow rejected the anticipatory bail plea of a man and his family members, even though they were never arrested during the investigation.
- Medical Condition: A CBI court in Ghaziabad refused bail to an accused suffering from cancer.
Expressing concern over these violations, the Supreme Court reiterated that its rulings are the law of the land and must be followed. The bench highlighted that despite a prior warning, some judges continued to disregard the court’s verdict.
Supreme Court’s Response
The Supreme Court directed the Allahabad High Court to take necessary action and ensure that the judge in question undergoes skill enhancement training at the judicial academy. The court emphasized the importance of protecting personal liberty and granting bail in cases where detention is unnecessary.
The bench also directed that training be provided to prosecutors so they do not oppose bail without valid reasons. It instructed governments and prosecuting agencies, including the CBI, to educate their prosecutors on the Supreme Court’s ruling to ensure proper legal proceedings.
This action by the Supreme Court aims to uphold justice and prevent unwarranted detentions, ensuring that judicial authorities follow established legal principles.
