Madhya Pradesh HC: Mere Mention of Family Members in 498A Cases Does Not Justify Legal Action

The Madhya Pradesh High Court has ruled that in cases filed under Section 498A of the IPC, mere mention of family members’ names without proof of their active involvement does not justify legal action against them.

Case Background

A woman had filed an FIR against her husband and in-laws under Section 498A, 323/34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. She alleged that her husband and in-laws harassed her for dowry and demanded ₹10 lakh from her family.

However, the accused in-laws challenged the FIR, stating that they had no role in the alleged harassment and that the complaint was made years after the marriage.

Court’s Observations

Justice Rajendra Kumar Verma, presiding over the case, noted that:

  • The complainant had lived with her in-laws for a long time but never raised allegations before.
  • The FIR was filed almost five years after the marriage, which raised questions about its credibility.
  • No prior complaints had been lodged before the police or other authorities.

The court cited the Geeta Mehrotra v. State of UP case, which stated that casually mentioning multiple family members in an FIR without proving their involvement does not justify legal proceedings against them.

Verdict and Legal Implications

The Madhya Pradesh High Court ruled that unless there is clear evidence of active participation in the alleged harassment, family members cannot be prosecuted under Section 498A. The decision reinforces the importance of preventing misuse of dowry laws while ensuring genuine cases receive due justice.
