“Husband and Wife Should Live Together with a Sense of Adjustment”: MP High Court

Justice Rohit Arya and Justice Milind Ramesh Phadke of the Madhya Pradesh High Court made this observation while addressing an appeal filed by a wife against a decree for Restitution of Conjugal Rights (RCR) awarded in favor of her husband.

The couple married in April 2015 but started living apart just days later, in May 2015. In May 2018, the husband filed a petition for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955, in the Court of First Additional District Judge, Dabra, Gwalior.

Recognizing his sincere intentions, the court awarded the decree. The wife then appealed to the High Court to challenge this decision.

During the hearing, the wife expressed her willingness to live with her husband and indicated she did not wish to continue the appeal. The husband assured the court that he would ensure her dignity and provide a comfortable and respectful living within his means.

The court appreciated the husband’s gesture and upheld the decree passed by the First Additional District Judge, Dabra, District Gwalior.
