Bombay High Court Quashes Rape Case Against Lawyer, Says Relationship Turned Sour
The Bombay High Court has quashed a rape case filed against a Mumbai-based lawyer, stating that the accusations came from a personal relationship that went wrong.
The woman had filed a case under several sections of the Indian Penal Code (IPC), including Section 376(2)(n) (repeated rape), Section 504 (insult), and Section 506 (threats). She and the lawyer were old schoolmates who reconnected in 2020. At the time, she was married and living in the US, but returned to India with her child after facing problems in her marriage.
She decided to file for divorce and reached out to the lawyer for legal help. Later, they became close and got into a physical relationship. According to her, he took advantage of her emotional state, but the lawyer said the relationship was completely consensual.
The Court noted that there were financial transactions between the two. The woman had transferred ₹33 lakh to his account. The lawyer claimed ₹28 lakh was a loan and ₹5 lakh was payment for legal services. He also said he had returned the full loan by August 2022. After that, the woman allegedly asked for ₹5 lakh more and threatened to file a false rape case if he refused.
After reviewing the complaint and the chargesheet, the court said the rape allegations lacked solid evidence. The judges, Justice Bharati Dangre and Justice Manjusha Deshpande, said the woman had willingly taken part in the relationship, and the situation was more about a failed personal and financial relationship, not a criminal case.
The Court concluded that continuing the case would be an abuse of the legal process, as it would not likely result in a conviction. As a result, the charges were dismissed, and the case was officially closed.
