Gauhati High Court Grants Bail to Rajkanya Baruah in Fatal Road Accident Case

The Gauhati High Court has granted bail to Rajkanya Baruah, who was involved in a serious road accident in Guwahati that led to the death of one person and injured seven others. The incident occurred on October 2 of last year in the Rukminigaon area of the city when Baruah, driving under the influence of alcohol, struck a group of road workers while driving recklessly at around 1 am.

Baruah, who had been in custody at Guwahati Central Jail for the past five months, had been applying for bail. On Wednesday, March 9, the court granted her bail on a surety of Rs 50,000. She left the jail premises at around 8 am that day.

In its order, the court addressed the key issue of whether her actions on the night of the accident were intentional or reckless, stating that this will be determined based on witness testimonies during the trial. The court also noted that there was no risk of Baruah, who is a woman, influencing witnesses or attempting to evade trial.

The court order read, “To decide whether the act of the accused was done with the intention of causing bodily harm likely to result in death or if it was a case of homicide not amounting to murder, the state of mind of the accused at the time of the incident depends on the evidence to be provided by witnesses during the trial.”

The court concluded that granting bail to Rajkanya Baruah would not hamper the trial, and thus, her liberty could be restored while the case proceeds. However, the trial will continue to determine her level of responsibility for the accident.

This case, involving reckless driving and the tragic loss of life, has drawn significant public attention. The decision to grant bail underscores the legal principle that bail does not imply acquittal, but ensures that an accused person can await trial without being incarcerated unless there is a risk of interference with the judicial process.

The trial will now proceed, where witness testimonies and further evidence will play a crucial role in determining the outcome of this tragic case.
