The Delhi High Court recently quashed an FIR filed under Section 377 of the Indian Penal Code (IPC) after a settlement between a husband and wife was reached. Justice Talwant Singh observed that in matrimonial cases where disputes are resolved amicably, such offences can be compromised to help both parties move on with their lives.
In this case, the husband sought to quash the FIR based on the fact that he and his wife had reached an agreement in September of the previous year. According to the settlement, the husband agreed to pay ₹74 lakhs to his wife as a full and final settlement of all claims, including Stridhan, child maintenance, and permanent alimony. Out of this amount, ₹10 lakhs were to be invested in the name of their minor child, which would be available once the child reaches adulthood.
Additionally, it was agreed that the wife would retain sole custody of their child. The husband would have the right to a video call with the child for one hour on the child’s birthday, or alternatively, he could meet the child for an hour each week.
The court also quashed the charges under Section 354 IPC, stating that the resolution of these disputes would allow the couple to close this chapter of their lives and begin anew. Both parties were reminded that they must adhere to the terms of the settlement and the promises made in court.
The court disposed of the plea, bringing the case to a close.
